Single mother in her early 50s needs assistance with a guardianship for her 28 year old son. Proposed ward has a mental health condition that is managed by medication; however, when he does not take his medication, he is mentally incapacitated. When proposed ward is incapacitated, he unable to provide for his basic day-to-day living, such as his personal hygiene, and he is prone to leaving the home and wander. Client is very concerned for the proposed ward's safety. As regaining full capacity is unlikely, a guardianship is recommended by his primary care physician. Proposed ward is currently in the care of facility. Client does not have any access to proposed ward, and she is unaware of his current state of health. Client believes that proposed ward may contest the guardianship. Additionally, as proposed ward's mental health condition can be managed by medication, it may be possible that the matter can be handled through a lesser restrictive alternatives, such as supported decision making document, a psychiatric advance directive, or powers of attorney.
